ABC22 & FOX44’s Matt Holderman sat down with Franklin County Sheriff John Grismore on Wednesday, two days after Grismore was relieved of a simple assault charge stemming from an August 2022 incident where he kicked a shackled detainee.

After jurors twice failed to reach a verdict in the case, State’s Attorney Doug DiSabito said he had “determined that a third trial is not in the public interest.”

Franklin County Sheriff John Grismore was caught on video kicking a detained man in 2022. He will not face a third trial, the prosecutor said.

Last week’s trial was the second of Grismore’s to end with a hung jury in a Grand Isle County courtroom. The first – held this past summer – also ended without a final determination following almost four days of testimony. .

After more than 17 hours of deliberations this week and last, jurors could not come to a consensus in Grismore’s case for a second time.

On Monday, Grand Isle State's Attorney Douglas DiSabito said the charge against Grismore has been dismissed with prejudice, meaning he cannot be tried again.

The jury must rule on whether Grismore violated the use of force policy after he made contact with a man in police custody back in August 2022.
